Tax Law FAQ |
From criminal to civil charges: We will first seek to have the charges moved from criminal to civil. Then we will work to eliminate or reduce penalties, liens, and levies. If the matter becomes a civil charge, we will work for resolution through a payment agreement or an offer in compromise.
- Your criminal defense team: To help us resolve criminal tax charges, one of our team members is a former special agent of the IRS Criminal Division. His experience is invaluable in helping defend criminal tax charges. If the charges include other crimes, we will bring in a criminal defense lawyer more experienced in the area of law. Every member of your criminal defense team will be focused on the best ways to handle your case and protect your rights.
- Tax crimes and penalties: A tax crime conviction can result in severe penalties including prison time, substantial fines, and civil tax penalties and interest. Tax crimes we have handled include failure to file income tax returns, filing a return containing false information, willfully underreporting income, and tax evasion.
- Contact a tax attorney : If you know or suspect that you are the target of a criminal investigation, consult an experienced tax attorney immediately. Any conversations you have with an attorney are generally protected by attorney-client privilege. Anything you say to an accountant, CPA, enrolled agent, or other non-attorney not employed by an attorney can be used against you.
- Voluntary disclosure: The Internal Revenue Service has an amnesty program called the Voluntary Disclosure Policy. Under this program, the IRS will typically decline criminal prosecution in cases where a taxpayer comes forward prior to the initiation of a criminal investigation, voluntarily discloses the error, and then makes an effort to pay whatever is owed. If you make a voluntary disclosure, make sure you are represented by a tax lawyer who will protect your rights and interests.
